LiveO2 Prime Use Terms and Conditions
The concepts, ideas, and designs presented by LiveO2. are, and shall remain, the intellectual property of the company. No information may be disclosed to anyone other than LiveO2 users and their families.
1. Non-Disclosure of Proprietary Information.
The Parties agree that from the date of receipt, the party receiving the Confidential Information (hereinafter the "Receiving Party") shall not disclose Confidential Information to any other person, firm, corporation or other entity or use it for its own benefit except as provided in this Agreement. The Receiving Party shall not publish, divulge, communicate, or reveal any Confidential Information to any person, corporation, or other third party or to any of Receiving Party’s employees who do not have a need to know such Confidential Information with respect to their job duties.
2. No Formal Business Obligations
This Agreement shall not constitute, create, give effect to, or otherwise imply a joint venture, pooling arrangement, partnership, or formal business organization of any kind, nor shall it constitute, create, give effect to, or otherwise imply an obligation or commitment on the part of either party to submit a proposal to or perform a contract with the other party. The Parties, by the signatures of their authorized representatives appearing below, acknowledge that they have read and understand each and every term of this Agreement.
3. Experimental Technology with no express or implied warranty
I accept and agree that any and all methods described on LiveO2 Prime are experimental. They have not been reviewed by any regulatory authority including the Food and Drug Administration. The have not been reviewed or tested for safety or efficacy for any medical condition.
I agree that if I consider any method is inappropriate or may be harmful I will not attempt to do it. If I choose to experiment, then any adverse or undesirable effect are my sole responsibility.
4. Acceptance of Agreement Acknowledgement of Informed Consent by Login
The actions which I have taken to access this site constitutes my acceptance of all terms of this agreement. This includes submission of my email and clicking the login links or buttons to access content herein.
The term of the agreement shall remain in effect for 5 years from the last time I accessed LiveO2 Prime or utilized any methods disclosed herein.
5. Expressed Informed Consent
I further accept and agree that performing any action disclosed any protocol or educational collateral constitutes my acceptance of informed consent. I understand that EVERYTHING disclosed on the LiveO2 Prime site, or disclosed by any person associated, or supporting is experimental and my comprise a hazard or cause effects which may be harmful or cause discomfort.
I understand accept that informed consent. Informed consent is legally defined in the Nuremberg Code, and it requires that I understand the potential consequences of an experiment, and I give voluntary consent and that the potential benefits outweigh any and all risks.
Informed means that I understand to my necessary comfort the nature, character and possible consequences of any method or protocol disclosed on LiveO2 Prime or any associated person.
Consent means that I have not been coerced, or threatened in any way to perform and act or take any substance by any individual. I agree that I will decline to participate in any act absent informed consent.
I declare that I understand that I will only participate or conduct experiments disclosed on this site with my informed consent. I will decline any and all actions, which are not willful and voluntary.
I understand that all guidance and training are intended to enable me to achieve informed consent.
I will not participate in any event or experiment until I feel sufficiently informed that it is safe and appropriate for me, or those in my guardianship, to do.
6. Self Actuated
I further understand agree and accept that all experiments are conducted by me on me. My actions to perform any training or consume any substance is my own choice and conducted purely at my discretion. My actions are my responsibility I hereby agree to hold all others harmless for my own actions.
6. Waiver of Any and All Liability
I waive all liability for myself and prohibit any and all representatives of my estate, family and all others with any family, business or personal relationships from seeking any remedy against LiveO2, personnel, trainers volunteers, or all others attempting to support my experiments with technology represented on LiveO2 Prime.
I agree that all information provided on LiveO2 Prime, and by staff and volunteers as educational material. I understand and accept that this information is solely intended to enable me to make informed decisions about what actions, supplements and methods I will use to pursue my own health and fitness.
I further agree that if I am engaging in support of others in my guardianship, including minors, that I fully waive any and all liability to any and all parties involved in LiveO2 Prime. Under no circumstances will I hold anyone except myself liable for anything.
7. No Medical Advice
The information being provided on LiveO2 PRIME is being provided strictly as a courtesy to customers and subscribers. I understand no participants including peers, trainers, or others who may respond to inquiry, or engage in support activity are acting as a medical advisor, health advisor, nurse or in any professional capacity.
8. Trade Secrets
Any information pertaining to the function of ANY LiveO2 devices or equipment are considered Trade Secrets and may not be disclosed.
